Terms of use

These Terms govern your access to and use of StarPower Passport ("Passport"), provided by PUMPS & ELECTRICAL PTY LTD (ABN 29 680 127 379), trading as StarPower Advance Solar Technology ("StarPower", "we", "us" or "our"). By creating an account or using Passport, you agree to these Terms, the Privacy Notice and the Safety Disclaimer. If you do not agree, do not use Passport.

1. Eligibility and authority

You must have legal capacity to accept these Terms. If you use Passport for another person or an organisation, you confirm that you are authorised to accept these Terms for them.

2. What Passport provides

Passport is an ownership-record and general information service. It can help you organise setup details, products, serial numbers, purchase and warranty references, manuals, private photos, reminders and internal support requests. Some features may be unavailable or disabled.

Passport may offer paid digital subscription plans through Stripe-hosted checkout. It does not sell the physical products recorded in a passport. Physical purchases from StarPower or another retailer remain governed by the separate sales, shipping, returns and warranty terms presented through that retail channel. Recording or importing a product or order does not change those terms.

3. Accounts

You must provide accurate account information, keep it reasonably up to date, protect your password and promptly notify us of suspected unauthorised access. You are responsible for activity carried out using your account unless it results from our failure to take reasonable care or another matter for which the law makes us responsible. You must not share access in a way that defeats the service's customer or admin access controls.

4. Your records and content

You retain ownership of information and files you submit. You give us a limited, non-exclusive permission to host, copy, process and display that content only as reasonably necessary to operate, secure, support and administer Passport, comply with law, and exercise our rights under these Terms. This permission ends when the content is deleted from our active systems, subject to lawful retention and routine backup cycles.

You are responsible for ensuring that your content is accurate, lawful, relevant and does not infringe another person's rights. Do not upload malicious code, unlawful material, unnecessary sensitive information, or images or documents you are not entitled to use.

5. Acceptable use

You must not:

• access or try to access another customer's records or files;
• bypass authentication, row-level security, role restrictions, usage limits or other safeguards;
• disrupt, probe, reverse engineer or misuse Passport, except to the extent a law gives you a right that cannot be excluded;
• use Passport for fraud, unlawful conduct, infringement, harassment or safety-critical control of equipment; or
• submit content that is false, harmful, unlawful or designed to compromise the service or another person.

6. Safety and professional advice

Passport is not a substitute for product manuals or professional electrical, engineering, installation, structural, compliance, emergency or legal advice. It does not certify an installation or determine whether equipment is safe, compliant or compatible. Do not rely on Passport to perform wiring, mains, battery, inverter, charging, fuse, protection or other safety-critical work. Follow manufacturer instructions and use appropriately qualified professionals.

If equipment is smoking, sparking, unusually hot, damaged, producing a burning smell or presenting a shock or fire risk, keep away and contact an appropriate qualified professional or emergency service.

7. Product, warranty and upgrade information

Customer-entered records, catalogue placeholders, reminders, compatibility rules and upgrade-planning outputs may be incomplete or become outdated. Verify important details against the product label, current manufacturer documentation and applicable professional advice. Passport does not approve a warranty claim, guarantee performance, confirm ownership, place an order or make a legal or compliance decision.

8. Optional integrations

Shopify synchronisation, order lookup, Freshdesk ticket creation, AI advice, subscription billing, email notifications, recycling, trade-in and marketplace requests are optional features and may not be available to every account or workspace. Third-party provider terms or notices presented during use also apply. You may choose not to use an optional feature. Recycling, trade-in and marketplace submissions are requests for human review only and do not create a booking, sale, valuation, ownership transfer, warranty decision or payment unless separately confirmed.

9. Paid subscriptions

Available plans, billing intervals, prices and applicable taxes are shown before you confirm Stripe-hosted checkout. A subscription renews for the selected interval until cancelled. You can manage payment details or cancel through the billing portal; cancellation normally takes effect at the end of the current paid period unless the checkout terms or applicable law require otherwise. Access to paid features may be restricted if a payment fails or a subscription ends. Except where required by law or expressly stated at purchase, fees already paid are not refundable. Nothing in this clause limits rights under the Australian Consumer Law.

10. Availability and changes

We use reasonable care in operating Passport, but we do not promise that it will always be available, uninterrupted or error-free. Maintenance, security events, provider outages or circumstances outside reasonable control may affect availability.

We may improve, change or discontinue features. Where a change materially reduces the core service, we will provide reasonable notice where practicable. Urgent security, legal or safety changes may take effect immediately. If you do not accept a material change, you may stop using Passport and request account closure or access to your personal information.

11. Suspension and account closure

You may stop using Passport and request account closure at any time. We may restrict or suspend access where reasonably necessary to address a security risk, unlawful activity, a material breach of these Terms, harm to another person or a legal requirement. Where appropriate, we will give notice and a reasonable opportunity to remedy a breach. We may act immediately where delay would create material risk.

On closure, your access ends and we handle retained or deleted information as described in the Privacy Notice. Clauses that by their nature should continue—including ownership, accrued rights, lawful retention, consumer protections, liability and dispute terms—survive closure.

12. Third-party services and links

Passport relies on service providers for hosting, authentication, database and private storage and may link to manufacturer manuals or third-party sites. Third parties operate under their own terms and privacy practices. We are not responsible for third-party content or services except to the extent applicable law makes us responsible.

13. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded, restricted or modified.

14. Disclaimers and liability

Subject to clause 13, Passport is provided as a general record-keeping and information service. To the extent permitted by law, we are not responsible for loss caused by inaccurate or incomplete information you or a third party supplies, your failure to follow product documentation or qualified advice, unauthorised use of your account that was not caused by our failure to take reasonable care, or third-party services outside our reasonable control.

We do not exclude liability for our fraud, wilful misconduct, negligence where it cannot lawfully be excluded, or breach of a non-excludable statutory guarantee. Each party remains responsible for loss caused by its own breach of these Terms or applicable law. Nothing in these Terms requires you to indemnify us for loss caused by us.

15. Disputes

Please first contact us using the details below and describe the issue. We will try to resolve it in good faith. Nothing in this clause prevents either party seeking urgent relief or using a regulator, tribunal, ombudsman or court where entitled to do so.

16. Governing law

These Terms are governed by the laws of New South Wales and applicable Commonwealth laws of Australia. The parties submit to the courts and tribunals that have jurisdiction in New South Wales, but this does not prevent you relying on a non-excludable right to bring a claim in another jurisdiction.

17. Changes to these Terms

We may update these Terms for legal, security or service changes. We will publish the updated Terms with a new effective date and give reasonable notice of a material change where practicable. Changes apply prospectively. Continuing to use Passport after the notified effective date means you accept the updated Terms; otherwise, you may stop using Passport and request account closure.

18. General

If a provision is unlawful or unenforceable, it is read down or severed to the minimum extent necessary without affecting the remaining provisions. A failure to enforce a right is not a waiver. These Terms, the Privacy Notice, Safety Disclaimer and any feature-specific terms form the agreement for Passport and do not replace separate terms for a retail purchase.
